Letter 10005: The matters I described in my previous letter continue to require your attention.

TO SAVINUS THE SUBDEACON. [Summary heading:] Let him admonish Maria to fulfill at last her father's will, and to pay out, even against her will, the two ounces [of property] left both to the freedmen and to the church of Saint George. Gregory to Savinus the subdeacon. The bearers of these presents, Stopaulus and Marcellus, formerly freedmen of Comitiolus among the bodyguards [excubitores], have complained to us, asserting that the two ounces of property which their lord, the same man, had bequeathed to his freedmen through the document of his will, have not yet been made over to them by his heir Maria, his daughter, the wife of Pardus the cleric. And in order that she may be able to defer the legacy itself, they intimate that intimidation concerning their own status is being directed at them by the same heir. And since the things which have been left demand to be fulfilled by your diligence, therefore by this authority we direct you to admonish the aforesaid Maria, so that she does not defer to fulfill the will of her father and author, and that it be your endeavor that they ought not to be subjected to any losses contrary to reason. But if perchance she strives to defend herself from this discharge [of the obligation] by some excuse, it befits you, with the most sacred Gospels set in the midst, to investigate the case subtly, and so to determine what the order of law and justice shall have demanded, and to consign what has been determined to effect, so that this complaint may not come again to us. But since we have learned that the aforesaid testator bequeathed two ounces of his property to the church of Saint George, where he wished to be buried, let it be your care that you ought by all means to vindicate those same two ounces, if they have not yet been made complete, for the aforesaid place, so that the intention of his pious will, even against the heir's wishes, may through all things be brought to effect, and that you do not suffer the matters that have been reported to be deferred any longer in this affair. "For it is sacrilege and against the laws, if anyone attempts, by the zeal of a perverse will, to retain for his own profit what is left to venerable places" (Gratian 17, question 4, chapter 4).
